Acceptance of the Terms and Conditions

These terms of use are entered into by and between you and AEO Europe Retail Co. B.V. (”AEO EU,” “we,” or “us”) registered with the Netherlands Chamber of Commerce (KvK) under number 86530763, RSIN: 863997260, with a registered address of Spuistraat 9, 2511BC ’s-Gravenhage, Netherlands and email of privacy.aeo@aeo.eu. The following terms and conditions (“Terms and Conditions”) govern your access to and use of https://www.aeo.eu, including any content, functionality, services offered, and purchases made on or through https://www.aeo.eu (the “Website”).

Please read these Terms and Conditions carefully before you start to use the Website. By using the Website, you accept and agree to be bound and abide by these Terms and Conditions, our Privacy Notice, found at www.aeo.eu/pages/privacy-notice, and our Cookie Notice, found at www.aeo.eu/pages/cookie-notice both of which are incorporated herein by reference. If you do not want to agree to these Terms and Conditions, the Privacy Notice, or the Cookie Notice, you must not access or use the Website.

This Website is offered and available to users who are 13 years of age or older. These Terms and Conditions apply to all offers, orders, and agreements made through the Website. The Website is directed at users in the European Union, European Free Trade Association, and the United Kingdom.

We may revise and update these Terms and Conditions from time to time in our sole discretion. All changes are effective immediately when we post them and apply to all access to and use of the Website thereafter.

We reserve the right to withdraw or amend this Website, and any service or material we provide on the Website, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Website is unavailable at any time or for any period. The Website and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by the us, our licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms and Conditions permit you to use the Website for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Website.

The Order Process

We aim to make our order process as smooth and straightforward as possible. Below is a step-by-step guide to concluding an order with us on the Website:

On occasion, information on the Website may contain errors, including, without limitation, typographical errors, inaccuracies, or omissions related to product availability, special offers, product promotions, pricing information, product descriptions, or product shipping charges and transit times. AEO EU reserves the right to, at any time and without prior notice, correct any errors, inaccuracies or omissions and to change or update information or cancel orders if any information on the Website is inaccurate (including after you have submitted your order). Products offered through the Website are offered subject to availability. While we do our best to ensure that product and pricing information is current and complete, we are not liable for inaccurate information or for any information that has been omitted or is out of date. 

We may, from time to time, offer promotions for shipping and other discounts on purchases. We reserve the right to suspend any such promotions, update product information, change prices and adjust shipping and handling fees at any time without notice. Furthermore, we reserve the right to change, limit, refuse, or cancel any order you place with us in our sole discretion. In the event we make a change to or cancel an order, we will attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. 

By entering into any transaction through the Website, you warrant and represent that all information you provide is true and correct (including, without limitation your credit card information and billing address), that any credit card transactions submitted by you are authorized, and that you are the legal holder of any credit card or payment account used to enter into any transaction through this Site. When you receive an order acknowledgement email, we're busy confirming your order is in stock and all the details are correct. The contract between us doesn't form until we've completed these checks and taken payment, following which you'll receive an order confirmation email.

By entering into any transaction through the Website, you will receive email communications from us regarding this transaction, including purchase receipts, notices, or transactional messages. Shipping, Payments, Promotions

Even though we do our very best to deliver within the communicated time frame, delivery may sometimes take longer due to unexpected events. If your order does not arrive by the estimated time of delivery, please contact Customer Service at help.aeo@aeo.eu and they will try their best to help you.


Returns and Right of Withdrawal

Under consumer protection law, you have the right to cancel all or part of your purchase for any reason by notifying us within 14 days from the day you receive your order.


To exercise your right of withdrawal, contact our customer services team at help.aeo@aeo.eu visit the Returns Page of this Website, or fill out the model form attached as Annex A to these Terms and Conditions within the 14-day withdrawal period, notifying us of your intention to exercise your right of withdrawal. To exercise your right of withdrawal, you must return your items to us within 14 days from the moment you notify us of your intention to withdraw. Please ensure that the items are in their original condition, including all packaging. You are responsible for the cost of return postage and packaging.


The right of withdrawal and return does not apply to products that are sealed and which are unsuitable for return for reasons of health protection or hygiene if the seal has been removed, such as certain underwear, swimwear, beauty products and cosmetics.

Defects

We will, depending on the item, relevant defect, and your request, offer to repair or replace the item with a new one for any item deemed defective. If this is impossible or would generate disproportionate costs, we will offer you a price reduction or refund depending on your preference.

Liability

Your mandatory legal rights are not affected by these Terms and Conditions.

We do not exclude or limit our liability to you if it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, fraud, or breach of your mandatory consumer rights. To the extent permitted by law, we exclude all warranties except those that cannot be lawfully excluded for the benefit of consumers and users.

If we don't follow these Terms and Conditions, then we'll be responsible for the part of any foreseeable loss or damage that you suffered that was caused by us. In addition, even if we don't follow these Terms and Conditions, we won't be responsible for any loss or damage that isn't foreseeable.

Use of this website is at your own risk. We are not liable for any technical interruptions, data loss, or temporary unavailability of the website. Nothing in this section limits your statutory consumer rights.
